The SESC recommended the Prime Minister and the Commissioner of the FSA to take an administrative action against Vienna Capital (Japan) Ltd. ("the Company"), an Investment Advisory and Agency Business Operator. Based on the inspection of the Company, the SESC determined that the Company conducted the handling of private placements for foreign funds without registration.

The SESC recommended the Prime Minister and the Commissioner of the FSA to take an administrative action against Ohisama Energy Fund Co., Ltd., a Type II Financial Instruments Business Operator (“the company”). The SESC determined that, based on the inspection of Ohisama Energy Fund Co., Ltd., the company has been soliciting investors to the funds’ equities without properly ensuring segregation of the funds’ assets from those of the fund managers themselves.

The SESC recommended the Prime Minister and the Commissioner of the FSA to impose an administrative penalty charge of 400,000 yen against an employee of JAMCO CORPORATION. Based on an inspection, the SESC determined that the employee has violated the Financial Instruments and Exchange Act and committed insider trading by purchasing shares of JAMCO CORPORATION using information acquired internally.

The SESC recommended the Prime Minister and the Commissioner of the FSA to impose an administrative penalty charge of 1,370,000 yen against an employee of SoftBank Mobile Corp. Based on an inspection, the SESC determined that the employee of SoftBank Mobile, who was in charge of negotiating a contract with FLIGHT SYSTEM CONSULTING, INC., has violated the Financial Instruments and Exchange Act and committed insider trading by purchasing shares of FLIGHT SYSTEM using insider information acquired through the contract negotiation.
