Notice Regarding the Order Partially Amending the Regulation for Enforcement of the Labor Bank Act, the Order Partially Amending the Order for Credit Business of Agricultural Cooperatives and Federation of Agricultural Cooperatives, etc. and the Order Partially Amending the Regulation for Enforcement of the Shoko Chukin Bank, Ltd. Act Relating to the Ministry of Economy, Trade and Industry, Ministry of Finance, and the Cabinet Office

  On May 22, 2020, the national government promulgated and put into effect the Order Partially Amending the Regulation for Enforcement of the Labor Bank Act, the Order Partially Amending the Order for Credit Business of Agricultural Cooperatives and Federation of Agricultural Cooperatives, etc. and the Order Partially Amending the Regulation for Enforcement of the Shoko Chukin Bank, Ltd. Act Relating to the Ministry of Economy, Trade and Industry, Ministry of Finance, and the Cabinet Office.

  The outline of this notice is as follows.

(Note) The amendments of the Cabinet Order and Cabinet Office Order pertaining to banks, Shinkin banks, and cooperatives are not included. See here for the relevant amendments pertaining to these institutions.

1. Purpose

  An electronic payment service provider is required to conclude a contract with a labor bank, etc. for providing services (obligation to conclude a contract).

  Among electronic payment services, for API services such as a household bookkeeping application and accounting services, the obligation to conclude a contract is deferred until the day specified by Cabinet Order within two years from the enforcement date of the electronic payment service system (June 1, 2018). Electronic payment service providers conducting API services need to conclude a contract with a labor bank, etc. by the last day of this grace period.

  On April 30, 2020, the national government promulgated and put into effect the Cabinet Order to specify the last day of the grace period as May 31, 2020 (the latest day under the Act). However, there is a risk of delay in concluding contracts due to the spread of COVID-19 infection under circumstances where a Declaration of a State of Emergency was issued under Article 32, paragraph (1) of the amended Act on Special Measures for Pandemic Influenza and New Infectious Diseases Preparedness and Response.

  Accordingly, the national government also promulgated and put into effect the Order to extend the last day of the grace period until September 30, 2020, for any contract that a labor bank, etc. and an electronic payment service provider both intended to conclude by May 31, 2020, but could not conclude due to the spread of COVID-19 infection.

  As the current circumstances fall under the case "where it would be difficult to follow the procedures because the urgent establishment of Administrative Orders, etc. is necessary for the public interest" as prescribed in Article 39, paragraph (4), item (i) of the Administrative Procedure Act, procedures for public comment prescribed in the same Act were not followed for this Cabinet Order and Cabinet Office Order.
