Finalization of Cabinet Office Order to Partially Amend Cabinet Office Order on Financial Instruments Business, etc.

１．Result of the Public Consultation

The Financial Services Agency (“FSA”) published the following proposals for public consultation between January 18 and February 17, 2022.

• Cabinet Office Order to partially amend Cabinet Office Order on Financial Instruments Business, etc
• Regulatory Notice specifying necessary documents based on Article 2 (1) of the Cabinet Office Order on Financial Instruments Business, etc.
• Regulatory Notice specifying necessary documents based on Article 18 (1) of the Ordinance on Financial Services Providers’ Deposit for Operation

As a result, the FSA received 8 comments from 4 entities. The FSA greatly appreciates those who considered these proposals.

Appendix1 sets out the FSA’s responses to the comments received on the proposals.

２．Key Points of the Amendments

Foreign securities companies that newly enter Japan and meet certain requirements will be allowed to submit registration applications, etc. in English.

For specific details, please refer to Appendix 2 to 6.

３．Date of Promulgation and Enforcement

The Cabinet Office Order, the Ordinance and the Regulatory Notices have been promulgated and come into effect as of today, March 29 2022.
　Some of the provisions in this matter fall under Article 39, Paragraph 4, Item 8 of the Administrative Procedure Act, and therefore the public comment procedures prescribed in the said Act have not been conducted.
