The FSA proposed a draft amendment to the "Order for Enforcement of the Money Lending Business Act." The amendment clarifies that a cash advance taken by a non-resident, such as a visitor from abroad, through an ATM by using his/her foreign-issued credit card, is exempted from the regulation of the “Money Lending Business Act.”

The FSA proposed a draft amendment to the “Cabinet Office Ordinance on Prepaid Payment Instruments.” The amendment indicates that the refund on prepaid payment instruments is treated as exemption in the case where a foreign tourist who owns a prepaid payment instrument leaves Japan.

To call for more public attention, the FSA requested that the banks’ associations take precautionary measures in response to the recent leak of personal data at the Japan Pension Service for the prevention and information gathering of such unauthorized or fraudulent activities as unauthorized use of bank accounts and bank transfer fraud.

The FSA issued a warning against fraudulent requests for the card numbers of purchased prepaid payment instruments. This warning requests that the public refrains from giving the card numbers of purchased prepaid payment instruments to a fraudulent firm that intends to defraud the prepaid payment instruments.

Examples of fraudulent requests made by fraudulent firms that intend to defraud prepaid payment instruments;

  • -Request to pay for a sign-up fee to a sexually explicit site

  • -Request through email to pay for an access to a pay-per-use site that you have no recollection of visiting
