August 4, 2016:

Publication of the finalized amendments to the “Guidelines for Administrative Processes” regarding prepaid payment instruments issuers” « Summary» The FSA finalized amendments to the “Guidelines for Administrative Processes” regarding prepaid payment instruments issuers. In response to the increasing billing scams in which fraudulent entities aim to defraud ID numbers of prepaid payment instruments, the amendments add supervisory viewpoints for the improvement of prepaid payment instruments issuers’ compliance systems in light of fraud prevention and recovery. The Ordinance was enforced on August 4, 2016.

August 1, 2016:

Publication of draft amendments to the cabinet office ordinance and regulatory notices on financial instruments business « Summary» The FSA proposed draft amendments to the cabinet office ordinance and regulatory notices on financial instruments business pursuant to the enforcement of Margin Requirements for Non-Centrally Cleared OTC derivatives scheduled on September 1, 2016. The proposal includes measures to exclude the accepted Initial Margin from the deduction items of Equity Capital, and to exclude the deposited Initial Margin from the calculation of Risk Equivalents.

Updated lists of entities that are operating financial instruments businesses without proper registration (Kanto Local Finance Bureau and Fukuoka Local Finance Bureau) « Summary» The FSA, the Kanto Local Finance Bureau, and the Fukuoka Local Finance Bureau issued warnings to entities that are operating financial instruments businesses without proper registration. (cf. updated lists of Japan-based entities and business operators, etc., engaging in specially permitted business for qualified institutional investors)

Publication of the updated regulatory notices pursuant to the “Ordinance for Enforcement of the Act on Prevention of Transfer of Criminal Proceeds,” pertaining to the designation of the state or territory « Summary» The FSA published the updated regulatory notices pursuant to the “Ordinance for Enforcement of the Act on Prevention of Transfer of Criminal Proceeds,” pertaining to the designation of the state or territory. The updated notices allow the specified business operators to skip the proceedings of identification and verification when conducting transaction with a company that is listed or registered in the Indian market. The notices were enforced on August 8, 2016.
