March 1, 2019 Publication of the finalized amendments to the regulatory notices and guidelines pertaining to Pillar 3 disclosure requirements for internationally active banks regarding the capital adequacy open new window

The FSA finalized the amendments to the regulatory notices and guidelines pertaining to disclosure requirements for internationally active banks regarding the capital adequacy. The amendments mainly update the disclosure requirements with respect to G-SIBs (global systemically important banks) and CCyB (countercyclical capital buffer) based on the BCBS Standards: Pillar 3 disclosure requirements – consolidated and enhanced framework which was published in March 2017. The amended regulatory notices and guidelines will be enforced on March 31, 2019.

The FSA proposed the draft amendment to the regulatory notice designating transactions and lending/borrowing to be excluded from the transactions subject to the regulations on “Financial Instruments Obligation Assumption Business” based on the “Order for Enforcement of the Financial Instrument and Exchange Act.” The amendment aims to additionally designate certain transactions pertaining to the buying/selling and lending/borrowing of securities that are cleared by clearing organizations in the French Republic as transactions to be excluded from the transactions subject to the regulations on “Financial Instruments Obligation Assumption Business.”
