The FSA proposed a draft amendment to the regulatory notice designating transactions and lending/borrowing to be excluded from the transactions subject to the regulations on “Financial Instruments Obligation Assumption Business” based on the “Order for Enforcement of the Financial Instrument and Exchange Act.” The amendment aims to extend the applicable period (date of expiration) of the current regulatory notice from December 31, 2015 to June 30, 2016.
Excluded transactions are credit default swap transactions cleared by foreign clearing organizations that refer to foreign countries or foreign corporations, the selling/buying/lending/borrowing of bonds issued by foreign governments, companies, and etc., cleared by designated foreign clearing organizations, and foreign currency denominated interest rate swap transactions cleared by designated foreign clearing organizations.

The FSA (Local Finance Bureaus) updated its warnings about entities that are operating money lending businesses without proper registration. The warnings include the updated list of entities that misrepresent their registration using fictitious or stolen registration numbers.
Following entities were added to the list:
  • Kabushiki Kaisha Yunion*
  • Kabushiki Kaisha Kurūzu*
  • Kabushiki Kaisha Mirai*.
