Public Comments

September 18, 2026	Publication of the results of the public consultation on the draft partial amendments to the Comprehensive Guidelines for Supervision of Major Banks, etc., other Guidelines, etc. The Agreement on Reporting Procedures, etc. upon Occurrence of Damage Due to a Cyberattack (provisional translation) (inter-ministerial agreement reached on May 28, 2025) was revised on September 15, 2026. In addition to the conventional “Common Form for Reporting DDoS Attacks (Attached Form 1)” and “Common Form for Reporting Ransomware Attacks (Attached Form 2),” the revised agreement newly developed a “Common Form for Reporting Other Types of Cyberattacks, etc. (Attached Form 3)” (hereinafter, these forms are collectively referred to as the “Common Forms”). The FSA has so far presented forms to be used when making a report to the supervisory authority upon noticing the occurrence of a computer system failure or a cybersecurity incident in the Comprehensive Guidelines for Supervision of Major Banks, etc., other Guidelines, etc. However, as the inter-ministerial agreement was revised, the FSA decided to adopt the Common Forms based on the inter-ministerial agreement in lieu of the FSA’s conventional forms, and to partially amend the Comprehensive Guidelines, etc. The original press release is available in Japanese.
September 18, 2026	Promulgation of the Cabinet Office Order Partially Amending the Regulation for Enforcement of the Act on Investment Trusts and Investment Corporations and publication of the results of the public consultation on the relevant Cabinet Office Order With regard to the portion corresponding to the constituents of in-kind ETFs for which the ownership of those applying for establishing the ETFs exceeds 30%, the Cabinet Office Order aims to develop provisions to make it possible to establish the relevant portion with money. September 16, 2026	Promulgation of the Cabinet Office Order Concerning Amendments of the Financial Instruments and Exchange Act, etc. in 2023 and Amendments of the Act on Book-Entry Transfer of Company Bonds, Shares, etc. (to be enforced within three years and six months) and publication of the results of the public consultation on the relevant Cabinet Office Order The Act Partially Amending the Financial Instruments and Exchange Act and the Act Partially Amending the Act on Book-Entry Transfer of Company Bonds, Shares, etc. in Order to Respond to Environmental Changes, Including Advances in Information and Communications Technology were enforced. September 16, 2026	Publication of the results of the public consultation on the draft partial amendment of the Comprehensive Guidelines for Supervision of Financial Instruments Business Operators, etc. In May 2025, the International Organization of Securities Commissions (IOSCO) published the Revised Recommendations for Liquidity Risk Management for Collective Investment Schemes and accompanying Guidance. Based on the recommendations, etc., the Comprehensive Guidelines are to be amended as required in order to encourage investment management business operators to take appropriate measures concerning liquidity risk management for publicly offered investment trusts.  The original press release is available in Japanese.
September 15, 2026	Promulgation of the Cabinet Office Order Partially Amending the Cabinet Office Order on Definitions under Article 2 of the Financial Instruments and Exchange Act and publication of the results of the public consultation on the relevant Cabinet Office Order Outline of the amendment: 1) easing of the regulations on solicitations of digital corporate bonds, etc. by group companies of corporate bond issuers; 2) easing of the regulations on investment management in relation to collaboration with foreign venture funds; and 3) designation as securities of the rights to be indicated on depository receipts for which certificates are not issued.
