The SESC filed a petition with the Tokyo District Court for injunction against SRI BRAIN Co., Ltd. (“the Company”) and its manager to prohibit and suspend them from conducting the following activities. Based on the investigation of the Company, the SESC identified that it provided false information to its customers for fund solicitation.

The SESC recommended the Prime Minister and the commissioner of the FSA to impose an administrative penalty order of 3,825,000 yen against an offender who committed market manipulation for four days in violation of the Financial Instruments and Exchange Act.

Based on an inspection, the SESC determined that the offender had committed market manipulation by purchasing a large amount of shares of C&G SYSTEMS INC. and other securities.

Through these techniques, the offender intended to mislead the market of the Proprietary Trading System into believing that sales and purchases of the shares of C&G SYSTEMS INC. and other securities were thriving, and to cause fluctuations in market prices in his/her favor.

July 28, 2015:

Recommendation to impose an administrative penalty order against two offenders who received insider information from an officer of a negotiator with a tender offer and for committing insider trading related to shares of TOMEN ELECTRONICS CORPORATION.open new window

The SESC recommended the Prime Minister and the Commissioner of the FSA to impose an administrative penalty order of 5,580,000 yen in total against two offenders who had received insider information from an officer of a negotiator with a tender offer and are in violation of the Financial Instruments and Exchange Act.

The SESC determined, based on an inspection, that the offenders had committed insider trading by purchasing shares of TOMEN ELECTRONICS CORPORATION using the insider information.
