The FSA finalized the amendments to the “Cabinet Office Order on Disclosure of Corporate Affairs” based on the proposal presented in the Report by the “Working Group on Corporate Disclosure” of the Financial System Council, which was published in June 2018. The amended Cabinet Office Order enhances financial information and narrative (non-financial) information in annual securities reports. The Cabinet Office Order was enforced on January 31, 2019.

The FSA and local finance bureaus provide information regarding unauthorized use of bank accounts to relevant financial institutions and law enforcement authorities after obtaining consents from informants. The FSA has published statistics that include the number of information sharing on cases regarding unauthorized use of bank accounts until December 31, 2018 since September 2003, along with the corresponding actions taken by financial institutions.

The FSA updated the list of financial institutions signing up to the “Principles for Customer-Oriented Business Conduct” and publicizing their respective customer-oriented business approaches and KPIs (key performance indicators) inclusive of the common KPIs comparable across investment trust distributors by the end of December 2018 in order to visualize financial institutions’ initiatives and efforts. The FSA also published a trend analysis report on the common KPIs comparable across investment trust distributors taken by the respective financial institutions. The FSA aims at encouraging financial institutions to further “visualize” their customer-oriented business approaches and initiatives.

The FSA has been monitoring financial institutions from macro- and micro-perspectives as to whether their business approaches and initiatives reflect customer-oriented business conduct on a regular basis. In this respect, the FSA published the monitoring results pertaining to the status of major investment trust distributors’ implementation of customer-oriented business conduct. The distributors subject to the monitoring represent 9 major banks, 20 regional banks, and 7 major securities companies.
