Public Comments

August 7, 2026 Publication of the draft partial amendments to the Comprehensive Guidelines for Supervision of Major Banks, etc., other Guidelines, etc.
The Agreement on Reporting Procedures, etc. upon Occurrence of Damage Due to a Cyberattack (provisional translation) (inter-ministerial agreement reached on May 28, 2025) is scheduled to be revised. In addition to the conventional “Common Form for Reporting DDoS Attacks” and “Common Form for Reporting Ransomware Attacks,” the revised agreement will newly develop a “Common Form for Reporting Other Types of Cyberattacks, etc.,” which can be used for reporting other types of cyberattack cases. The FSA has so far presented forms to be used when making a report to the supervisory authority upon noticing the occurrence of a computer system failure or a cybersecurity incident in the Comprehensive Guidelines for Supervision of Major Banks, etc., other Guidelines, etc. However, as the inter-ministerial agreement is to be revised, the FSA decided to adopt common formats based on the inter-ministerial agreement in lieu of the FSA’s conventional forms, and compiled the draft partial amendments to the Comprehensive Guidelines, etc. Public comments will be accepted until no later than 5:00 p.m. (JST), September 7, 2026.

August 3, 2026 Promulgation of the Cabinet Office Order Partially Amending the Cabinet Office Order on Financial Instruments Business and publication of the results of the public consultation on the relevant Cabinet Office Order
The amendment aims to ease the requirements for individuals who may change their title to “professional investor” from the perspective of vitalizing investments by professional investors.

August 5, 2026 Publication of information on the organizational restructuring of the FSA
While working on various duties, including supervision of financial institutions and designing and planning of finance-related systems, the FSA has faced various new challenges in financial administration, such as the need to further develop initiatives for promoting Japan as a leading asset management center and implement other important policies, the need to respond to the advancement of digital technologies in the finance sector, and the need to enhance monitoring of financial institutions. In order to develop an environment enabling staff members to address these challenges meticulously, an organizational restructuring of the FSA will be implemented. The organizational restructuring, which is to be implemented under the Cabinet Order Partially Amending the Cabinet Order for Organization of the Financial Services Agency, etc., will become effective on August 7, 2026, when the relevant Cabinet Order is put into effect.

The regulations based on the Money Lending Business Act aim to prevent people from becoming multiple debtors or otherwise protect borrowers. On the other hand, when victims of the 2026 Kumamoto Earthquake intend to borrow money within their repayment ability from money lenders, there may be cases where they are unable to borrow money that they are originally entitled to, due to such reasons as being unable to prepare a certain document or failing to undergo other legally provided procedures. The risks of such inconvenience need to be eliminated. Accordingly, the Regulation for Enforcement of the Money Lending Business Act is to be partially amended.
